By accessing or using GetAds.co, signing up for a GetAds plan, purchasing any service from Fantom Agency LLC (doing business as GetAds), or otherwise using our website, platform, dashboard, or services, you agree to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions, you must not access or use the Site or Services.
1. Agreeing to Terms
These Terms & Conditions govern your use of the GetAds.co website, any client portal or dashboard made available by Fantom Agency LLC, and all services, subscriptions, products, add-ons, deliverables, and communications provided under the GetAds brand.
We may update or modify these Terms & Conditions at any time by posting an updated version on the Site. Your continued use of the Site or Services after any update constitutes your acceptance of the revised Terms & Conditions.
2. Definitions
“GetAds,” “Company,” “we,” “our,” and “us” mean Fantom Agency LLC, doing business as GetAds.
“Site” means GetAds.co, including any related websites, landing pages, subdomains, dashboards, portals, software, and communication channels used to provide our services.
“Services” means all subscription creative services, ad creative services, design services, video editing services, consulting, add-ons, one-time projects, ad bundles, strategy support, and any related products or services offered by GetAds.
“Client,” “you,” and “your” mean the individual or entity purchasing, accessing, or using the Services.
“Deliverables” means any draft, ad creative, design, video, file, source file, concept, or other output produced by GetAds as part of the Services.
“Your Content” means any text, documents, PDFs, images, videos, logos, trademarks, files, brand assets, copy, instructions, testimonials, claims, or other materials you upload, submit, send, or provide to GetAds.
“Plan” means any subscription tier, package, bundle, add-on package, promotional offer, legacy plan, grandfathered plan, enterprise agreement, pilot program, or future service configuration offered by GetAds.
“Active Request” means a creative request currently occupying one of the simultaneous work slots included in the client’s plan and actively being worked on by the GetAds team.
“Business Days” means Monday through Friday excluding company-observed holidays unless otherwise stated.
“Plan-Specific Terms” means pricing, billing intervals, active request capacity, included deliverables, and other commercial terms presented at checkout, on invoices, proposals, or written agreements.
3. User Representations
By using the Site or Services, you represent and warrant that:
a. all registration and billing information you submit is true, accurate, current, and complete
b. you will maintain the accuracy of such information and update it when necessary
c. you have the legal capacity to agree to these Terms
d. if acting for a company, you have authority to bind that entity
e. you are not a minor in your jurisdiction
f. you will not access the Site using automated scraping tools or bots without permission
g. you will not use the Services for illegal, fraudulent, deceptive, or unauthorized purposes
h. your use of the Services will not violate any laws or third-party rights
If any information provided is false or incomplete, we may suspend or terminate your account.
4. User Registration and Account Security
You may be required to create an account to use certain Services.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You agree to notify us immediately of unauthorized access or security breaches.
5. Services Overview
GetAds provides subscription-based ad creative and related production services including static ads, video ads, creative concepts, design support, revisions, and related deliverables depending on the selected plan.
All Services are provided subject to your plan limits, request complexity, internal capacity, workflow structure, and your responsiveness in supplying instructions and feedback.
GetAds reserves the right to determine what constitutes reasonable request scope, acceptable queue behavior, and proper operational use of the Services.
Use of Artificial Intelligence and Automation Tools
GetAds may utilize artificial intelligence systems, automation tools, and machine-assisted technologies in the creation of Deliverables.
AI-assisted outputs may contain similarities to other generated works. Clients remain responsible for reviewing Deliverables before publication and ensuring compliance with applicable laws and platform policies.
6. Fees, Billing, and Payment Authorization
You agree to pay all fees associated with your selected plan, add-ons, or services.
By purchasing Services, you authorize Fantom Agency LLC to automatically charge your payment method for recurring subscription fees, renewals, upgrades, add-ons, one-time purchases, taxes, and other authorized charges.
Subscriptions automatically renew according to the billing frequency selected at checkout unless canceled before the next renewal.
Charges may appear on billing statements under Fantom Agency LLC or GetAds.
If payment fails or is declined we may pause work, suspend account access, or terminate Services until payment is received.
7. Pricing Changes
GetAds reserves the right to change pricing, packaging, plan features, and service structures at any time.
Pricing changes for existing clients generally apply at the next renewal period unless otherwise agreed in writing.
8. Refund Policy Requirements
Eligible monthly subscription plans may include a 14-day money-back guarantee subject to the following conditions:
a. request submitted within 14 days of initial purchase
b. participation in onboarding or support if requested
c. submission of at least one genuine request
d. provision of necessary brand information
e. timely feedback on creative delivered
f. allowing the team reasonable attempts to address feedback
Refund eligibility is void if:
a. you approve any request
b. you download final or source files
c. the refund window has expired
d. you are beyond the first billing period
e. you materially interfere with delivery
9. Plans and Purchases Ineligible for Refunds
The following purchases are not eligible for refunds unless required by law:
- annual plans
- quarterly plans
- sponsored plans
- partnership programs
- beta or promotional offers
- ad bundles
- add-on services
- one-time creative purchases
- renewed subscription periods
- canceled or expired service periods
10. Credits, Prorations, and Service Usage
Credits issued by GetAds are:
- non-refundable
- non-transferable
- not redeemable for cash
- subject to expiration
Unused service capacity does not entitle the client to refunds or extensions.
Credits typically expire within 90 days unless otherwise stated.
11. Cancellation Policy
You may cancel your subscription at any time by contacting support at support@getads.co.
Cancellation prevents future renewals but does not create refunds for unused time unless otherwise specified.
12. Impact on Active Requests
Unfinished requests may be closed or paused at the end of a billing period following cancellation.
Clients are responsible for planning submissions to ensure completion within the active subscription period.
13. Delivery Output, Request Queue, and Fair Use
Clients may submit requests to their queue according to plan limits.
Work begins based on the number of Active Requests permitted under the plan.
Turnaround times or production estimates communicated on the Site or during sales conversations are estimates only and depend on complexity, feedback speed, and operational workload.
GetAds reserves the right to determine fair use and appropriate request scope.
14. Unlimited Requests Clarification
Where a plan references “unlimited requests,” this refers to the ability to submit requests to the queue.
It does not mean unlimited simultaneous production capacity.
Requests are completed sequentially based on queue order and Active Request capacity.
15. Priority Work and Urgent Requests
All requests are handled according to the queue structure of the selected plan.
Urgent or rush requests do not automatically move ahead in the queue.
Expedited or priority work may be offered only through separate add-ons or written agreements.
16. Non-Rollover and Unused Capacity
Unused requests or capacity do not roll over to future billing periods unless explicitly stated in writing.
Clients are purchasing access to a production system rather than guaranteed deliverable quantities.
17. Client Delays and Responsiveness
Clients must provide timely instructions, assets, and approvals.
If no response is received for 14 days we may mark requests inactive or closed.
Client delays do not pause billing.
18. Revisions
Revisions refine the original brief and do not restart the project.
Significant scope changes may require a new request or add-on.
19. Ownership and Intellectual Property
Ownership of final Deliverables transfers to the client after full payment.
GetAds retains ownership of internal tools, templates, workflows, and production methods.
Third-party assets remain subject to their respective licenses.
20. Your Uploaded Content
All materials you provide remain your property.
You grant GetAds a license to use Your Content for delivering the Services.
You are responsible for ensuring your content is lawful and authorized.
21. Responsibility for Your Content
You represent that your content does not infringe on third-party rights and complies with all laws.
GetAds does not guarantee platform compliance or advertising approval.
22. Portfolio and Marketing Rights
Unless otherwise agreed in writing, GetAds may display completed work in its portfolio and marketing materials.
23. Confidentiality
Both parties agree to protect non-public confidential information shared during the engagement.
24. Final Review Responsibility
Clients are responsible for reviewing and approving Deliverables before use.
Any publication or use of Deliverables constitutes acceptance.
25. No Guarantee of Performance
GetAds provides creative production services only.
We do not guarantee ad performance, conversion rates, revenue, or marketing results.
26. Disclaimer
Services are provided “as is” without warranties of any kind.
27. Limitation of Liability
To the fullest extent permitted by law, GetAds’ liability shall not exceed the greater of:
- $50 USD
- the total amount paid by the client during the three months preceding the claim
28. Indemnification
You agree to indemnify GetAds against claims arising from your use of the Services or Your Content.
29. Site Management and Suspension Rights
We may suspend or terminate accounts for violations, payment failures, or operational misuse.
30. Chargebacks and Payment Disputes
Initiating a chargeback without valid legal basis may result in suspension of services and recovery of unpaid balances.
31. Intellectual Property Rights in the Site
All website content and software remain the property of GetAds or its licensors.
32. Corrections
We reserve the right to correct errors or inaccuracies on the Site without notice.
33. Third-Party Websites and Tools
We are not responsible for third-party platforms or services linked through our Site.
34. Force Majeure
We are not liable for delays caused by events beyond our control.
35. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of Arizona.
Disputes must first undergo a 30-day good-faith resolution period.
Legal proceedings shall take place in Maricopa County, Arizona.
36. Entire Agreement
These Terms represent the full agreement between the parties unless superseded by a signed custom agreement.
37. Severability
If any provision is invalid, the remaining provisions remain in effect.
38. No Waiver
Failure to enforce any right does not waive that right.
39. Assignment
Clients may not transfer these Terms without written consent.
GetAds may assign these Terms in connection with corporate transactions.
